Microsoft shares tumble after weak 4Q results

Associated Press

Posted on July 19, 2013 at 12:01 PM

Updated today at 12:02 PM

NEW YORK (AP) ? Microsoft's stock is taking a hit after the software giant behind Windows, the Xbox and Surface tablets reported disappointing results for the latest quarter.

The results, which fell below Wall Street's expectations, included a large write-off for Microsoft Corp.'s surface RT business. A poor reception for Windows 8 contributed to a revenue drop in the company's operating system software unit.

Microsoft's stock is down nearly 11 percent to $31.59 in midday trading. The stock is still up about 18 percent year-to-date.

Microsoft announced a major reorganization late week, aimed at helping it transform into a "devices and services" company that is less reliant on providing software for personal computers. The earnings miss raised new questions as to whether the transition will succeed.

Russia opposition leader freed on bail, protests rattle Kremlin

By Gabriela Baczynska

KIROV, Russia (Reuters) - Russia unexpectedly freed opposition leader Alexei Navalny on bail on Friday, bending to the will of thousands of protesters who denounced his five-year jail sentence as a crude attempt by President Vladimir Putin to silence him.

Putin's spokesman called the protesters "mobs" and warned that the rallies were illegal.

In a highly unusual ruling that points to Kremlin uncertainty over how to handle Navalny's case, a judge approved the prosecution request to free him pending his appeal so that he can run in a Moscow mayor election on September 8.

The anti-corruption blogger will be unable to leave Moscow but hailed the decision, a day after he was convicted of theft, as a victory for people power.

Experts said it was unprecedented for the prosecution to seek bail on such terms after sentencing.

"I am very grateful to all the people who supported us, all the people who went to (protest in Moscow's) Manezh Square and other squares," the 37-year-old said, rushing across the court to hug his wife after he was let out of a glass courtroom cage.

The judge's decision was greeted by applause in the court in Kirov, 900 km (550 miles) northeast of Moscow. Under Russian law, he has 10 days to file an appeal and then the court has to decide whether to hear that appeal in 30 days.

"We understand perfectly well what has happened now. It's an absolutely unique phenomenon in Russian justice," Navalny said.

People poured onto the streets of Russian cities to protest on Thursday evening after Navalny was convicted of stealing at least 16 million roubles ($494,000) from a timber firm when he was advising the Kirov regional governor in 2009.

More than 200 people were detained although the rallies were peaceful, with demonstrators chanting "Shame!", "Freedom!" and "Putin is a thief!"

In Moscow, drivers honked their horns in support as they drove past at least 3,000 demonstrators a few hundred meters from the Kremlin's red brick walls.

Navalny says his trial was politically motivated and intended to sideline him as a threat to Putin, even though his support is limited outside the cities and opinion polls show the president is still Russia's most popular politician.

Putin has not commented on the verdict against Navalny or his release from custody. Putin's spokesman, Dmitry Peskov, said the rallies were illegal because they were held without approval from the authorities.

"There is no doubt that it is impossible to condone such mobs, and one can only hope that in the future everything will be done within the framework of the law," Peskov told reporters.

The trial was a matter for the courts "and has nothing to do with the president," he said.

KREMLIN CONCERN

Navalny led anti-Putin protests in Moscow which attracted tens of thousands of people at their peak last year. But they did not take off in the provinces, Putin's traditional power base, and faded after the former KGB spy was elected to a six-year third term as president in March 2012.

The sight of protesters so close to the heart of power on Thursday may have unsettled the Kremlin, and Friday's bail decision could be a political maneuver to head off new protests that would worry investors.

The judge ruled that keeping him in detention put "him on an unequal footing against other candidates (in the mayoral election) and restricts his right to be elected".

The current mayor, Sergei Sobyanin, a close Putin ally, said he would prefer to be challenged by Navalny, who opinion polls show is trailing him by a long way.

A source close to the mayor said Sobyanin, who is tipped as a potential prime minister, was worried the removal of Navalny as a candidate would tarnish his expected victory.

Some analysts said the Kremlin, and the business and security community around it, looked divided over Navalny.

"There really is a split in the elite and it seems there will be no peaceful outcome," said political scientist Ella Paneyakh, who described the bail request by the state prosecution as unprecedented.

SPLITS IN THE KREMLIN?

Putin is under no immediate political threat from Navalny, or any other opposition figure, but his grip on power has long depended on maintaining calm and a balance of forces between the conservatives and more liberal forces around him.

Cracks in the facade of unity have appeared, particularly over the removal from government of Vladislav Surkov, Putin's former political strategist, in May. Surkov had fallen foul of more hawkish Kremlin allies who are in the ascendancy as Putin takes a tough line against opponents after last year's protests.

"I think the split at the top of the Kremlin pyramid has now become absolutely obvious," said Alexei Roshchin, a veteran campaign adviser and sociologist.

"Before our very eyes the Navalny case is acting as a catalyst for the split in the elites."

Members of the Kremlin human rights council on Friday supported calls for an independent review of the case against Navalny, the Interfax news agency cited the advisory body's head, Mikhail Fedotov, as saying.

The United States and European Union voiced concern over Navalny's conviction, saying it raised questions about the rule of law and Russia's treatment of Putin's opponents.

"The fact that they were released under specific conditions is something that we can welcome, but how the whole case has been handled simply underlines our concerns," a spokeswoman for EU foreign policy chief Catherine Ashton said.

While it makes it easier for him to stay in the mayoral race, there is no indication Navalny's release from custody will affect the court's ruling on his planned appeal.

The acquittal rate in Russia is about half a percent, or one in 200, and has declined in recent years, said Pavel Chikov, a human rights lawyer and head of legal rights group Agora.

Putin acknowledges Snowden is 'trapped' in Russia (+video)

But he and Snowden agree on one thing: Snowden should leave Russia as soon as possible.

By Fred Weir,?Correspondent / July 15, 2013

Russian President Vladimir Putin, during his visit to the island of Gogland, 110 miles west of St. Petersburg, Russia, on Monday, July 15. Putin indirectly addressed Edward Snowden's renewed request for political asylum in Russia, noting that the former NSA contractor appears to be 'trapped' in Russia.

On Monday, Russian President Vladimir Putin indirectly addressed Edward Snowden's renewed request for political asylum in Russia, noting that the former National Security Agency contractor appears to be "trapped" in Russia. But, he added, he and Mr. Snowden are in agreement about about one important matter: he really shouldn't stay in Russia any longer than he needs to.

That said, Mr. Putin went on, Snowden has moved toward accepting the Kremlin's condition?that in order to be granted refuge in Russia he must stop leaking damaging NSA secrets to the global public.

"As soon as there is an opportunity for [Snowden] to move elsewhere, I hope he will do that,"?Russian news agencies quoted Putin as saying. "The conditions for granting political asylum are known to him. And judging by his latest actions, he is shifting his position. But the situation has not been clarified yet."

"There are certain relations between Russia and the United States, and we would not like you to harm them with your activity," said Putin, quoting Russian officials talking to Snowden during a conversation at Moscow's Sheremetyevo airport after he arrived. "He said no. He said, ?I want to continue my activity, fighting for human rights. I think the US is violating certain international regulations and intervening in private lives and my goal is to fight this.'"?

Unless Snowden definitively changes his attitude, Putin said, Russia will not help him.

At a meeting with Russian human rights workers and parliamentarians at Sheremetyevo?on Friday, Snowden insisted that his actions have not caused harm to the US, and said he would immediately renew his application for temporary asylum in Russia.

It's not clear whether Snowden's remarks meant that he intends to stop leaking NSA secrets. It may be out of his hands in any case. The Guardian's Glenn Greenwald, who's been spearheading most of the revelations, told journalists last week?that Snowden has already turned over a great many documents to him and he will be doing expos?s based on them for months to come.

As for remaining in Russia, Snowden really doesn't seem able to move along ? as Putin has repeatedly urged him to do???because the US has used all its tools of global influence to block Snowden's ability to travel anywhere beyond Moscow, Putin said.

"He arrived on our territory without an invitation, he was not flying to us. He was flying in transit to other countries. But as soon as he got in the air it became known, and our American partners, in fact, blocked his further flight," Putin said, referring to Snowden's stealthy June 23 flight from Hong Kong to Moscow aboard a Russian Aeroflot airliner.

Putin appeared to be claiming that Snowden's passport was only revoked after he boarded the Aeroflot plane, although other reports indicate that his passport was canceled at least a day before he fled Hong Kong. That would leave open the embarrassing question of how Hong Kong authorities and Aeroflot officials allowed him onto the Russian national airline's regular Moscow flight.

Snowden had an onward ticket from Moscow to Cuba for the next day, June 24, but he failed to use it for reasons that are still unclear.

"[The US] scared other countries. No one wants to accept him," Putin said.

According to some news reports, Putin added: "Such a present to us. Merry Christmas."

Putin's remarks suggest he may be leaning toward taking Snowden in at least temporarily, although the former KGB spy clearly has no enthusiasm whatsoever?for an idealist who refuses to defect in the traditional manner and publicly opposes government secrecy on principle.

But many other Russians, including leading parliamentarians,?have been urging the Kremlin to embrace the wayward ex-CIA employee who has done so much to undermine the image of the US as the global champion of freedom and democracy.

As of?Monday, Russian officials were maintaining that they have not yet received any asylum requests from Snowden.?

"There has been no application from Edward Snowden today," the independent Interfax agency quoted Konstantin Romadanovsky, director of Russia?s Federal Migration Service, as saying. "If an application is received, it will be examined under the established legal procedures."

Former brokers in court on Libor fraud charges

By Tommy Wilkes

LONDON (Reuters) - Two former brokers, who appeared in court on Friday on fraud charges, conspired with employees at UBS, HSBC, Rabobank, Citi and Tullett Prebon to manipulate Libor rates, prosecutors alleged in court documents.

Terry Farr, 41, and 48-year old James Gilmour, former staff at UK interbroker dealer RP Martin, are accused of conspiracy to defraud along with former Citi and UBS trader Tom Hayes.

The two men, arrested last December alongside Hayes, are the first brokers to face criminal action in connection with a global investigation into the Libor interest rate rigging scandal.

A central cog in the world financial system, the London interbank offered rate (Libor) is used as a price reference for hundreds of trillions of dollars worth of contracts, ranging from complex derivatives to everyday credit card bills.

The scandal has sparked public and political outrage and laid bare the failure of authorities and bank bosses to spot the manipulation.

So far, regulators have fined Britain's Barclays, Switzerland's UBS and Royal Bank of Scotland a total of $2.6 billion (1.7 billion pounds) and prosecutors have charged four men.

Hayes, Gilmour and Farr are the first to face court. The fourth suspect, Roger Darin, was charged by U.S. prosecutors last December. He is currently in Switzerland.

The case against the two men, who both live in the southeastern English county of Essex, will increase scrutiny of the role played in the scandal by interdealer brokers, who act as middlemen between the buyers and sellers of financial securities such as bonds, currencies or interest rate swaps.

Farr, dressed in a dark suit and tie, and Gilmour, dressed in an open neck white shirt, sat in the dock in London's Westminster Magistrates Court and spoke only to confirm their names and addresses and their bail conditions.

The two were granted bail until July 30, when their case will be transferred for a hearing at the higher Southwark Crown Court. They were told not to contact each other or Hayes, and they gave no indication of how they would plead.

Citi and UBS declined to comment. Tullett referred to a June 20 statement in which it said it was cooperating with UK authorities, and that it has not been informed that it or its brokers were under investigation. HSBC and Rabobank did not immediately respond to requests for comment.

According to court documents, Farr and Gilmour are alleged to have conspired with Hayes, who was then at UBS, and employees at the Swiss bank, Tullett, Rabobank, HSBC and others to defraud in dishonestly trying to influence the yen London interbank offered rate between August 2006 and December 2009.

Farr is also charged with conspiring with Hayes when the latter worked at Citi between December 2009 and September 2010.

British prosecutors have alleged in court that former trader Hayes conspired with staff from at least 10 financial firms, including brokers RP Martin, its much larger rivals ICAP and Tullett, and a string of banks, to rig rates.

For its part, UBS - which has paid the highest fine over the Libor scam to date, agreeing to a $1.5 billion penalty - admitted in December that its traders paid bribes to brokers in return for their help rigging interest rates.

Once-mighty Motor City files for bankruptcy

DETROIT (AP) ? Once the very symbol of American industrial might, Detroit became the biggest U.S. city to file for bankruptcy Thursday, its finances ravaged and its neighborhoods hollowed out by a long, slow decline in population and auto manufacturing.

The filing, which had been feared for months, put the city on an uncertain course that could mean laying off municipal employees, selling off assets, raising fees and scaling back basic services such as trash collection and snow plowing, which have already been slashed.

"Only one feasible path offers a way out," Gov. Rick Snyder said in a letter approving the move.

Kevyn Orr, a bankruptcy expert hired by the state in March to stop Detroit's fiscal free-fall, made the Chapter 9 filing in federal bankruptcy court.

Michael Sweet, a bankruptcy attorney in Fox-Rothschild's San Francisco office, said the city would pay current employees. But "beyond that, all bets are off."

"They don't have to pay anyone they don't want to," Sweet said. "And no one can sue them."

Detroit lost a quarter-million residents between 2000 and 2010. A population that in the 1950s reached 1.8 million now struggles to stay above 700,000. Much of the middle-class and scores of businesses also have fled Detroit, taking their tax dollars with them.

Beginning in the late 1960s, auto companies began opening plants in other cities. Property values and tax revenue fell, and police couldn't control crime. Then the rise of autos imported from Japan started to cut the size of the U.S. auto industry.

In recent months, the city has relied on state-backed bond money to meet payroll for its 10,000 employees.

Orr was unable to persuade a host of creditors, unions and pension boards to take pennies on the dollar to help facilitate the city's massive financial restructuring. If the bankruptcy filing is approved, city assets could be liquidated to satisfy demands for payment.

Snyder determined earlier this year that Detroit was in a financial emergency and without a plan for improvement. He made it the largest U.S. city to fall under state oversight when a state loan board hired Orr. His letter was attached to Orr's bankruptcy filing.

"The citizens of Detroit need and deserve a clear road out of the cycle of ever-decreasing services," Snyder wrote. "The city's creditors, as well as its many dedicated public servants, deserve to know what promises the city can and will keep. The only way to do those things is to radically restructure the city and allow it to reinvent itself without the burden of impossible obligations."

A turnaround specialist, Orr represented automaker Chrysler LLC during its successful restructuring. He issued a warning early on in his 18-month tenure in Detroit that bankruptcy was a road he preferred to avoid.

He laid out his plans in June meetings with debt holders, in which his team warned there was a 50-50 chance of a bankruptcy filing. Some creditors were asked to take about 10 cents on the dollar of what the city owed them. Underfunded pension claims would have received less than the 10 cents on the dollar under that plan.

Orr's team of financial experts said that proposal was Detroit's one shot to permanently fix its fiscal problems. The team said Detroit was defaulting on about $2.5 billion in unsecured debt to "conserve cash" for police, fire and other services.

"Despite Mr. Orr's best efforts, he has been unable to reach a restructuring plan with the city's creditors," the governor wrote. "I therefore agree that the only feasible path to a stable and solid Detroit is to file for bankruptcy protection."

Detroit's budget deficit is believed to be more than $380 million. Orr has said long-term debt was more than $14 billion and could be between $17 billion and $20 billion.

Orr's decision to file now may have been influenced by lawsuits filed by some city workers and retirement systems to prevent Snyder from approving a bankruptcy request from the emergency manager, said Detroit-area turnaround specialist James McTevia.

They have argued that bankruptcy could change pension and retiree benefits, which are guaranteed under state law.

Orr has said federal bankruptcy laws trump state law in this matter.

A bankruptcy judge will stay all the litigation, McTevia said.

"One court will adjudicate all these," McTevia said.

Some are concerned that a bankrupt Detroit will cause businesses large and small to reconsider their operations in the city. But General Motors, which filed and emerged from a Chapter 11 bankruptcy, does not anticipate any impact to its daily operations, the automaker said Thursday in a statement.

"GM is proud to call Detroit home and today's bankruptcy declaration is a day that we and others hoped would not come," the statement said. "We believe, however, that today also can mark a clean start for the city.

Detroit has more than double the population of the Northern California community of Stockton, Calif., which until Detroit had been the largest U.S. city ever to file for bankruptcy when it did so in June 2012.

Before Detroit, the largest municipal bankruptcy filing had involved Jefferson County, Ala., which was more than $4 billion in debt when it filed in 2011. Another recent city to have filed for bankruptcy was San Bernardino, Calif., which took that route in August 2012 after learning it had a $46 million deficit.

About 640 Chapter 9 bankruptcies have been filed since Congress enacted a revised Municipal Bankruptcy Act in 1937.

Mining for meaning: Getting computers to understand natural ... - Phys

Programs that can understand language and can identify meaningful links between the various parts of a text is the focus of work being carried out in Saarbr?cken by researchers like Ivan Titov. The computer scientist is currently developing a procedure that will enable computers to learn to identify semantically relevant relationships within texts. This research could mean that in future we will be able to ask our computer specific questions about the content of a text. The computer would then analyse the text and supply the user with the right answers.

Every student who was ever written a homework assignment or an academic essay is familiar with the problem: before you can start to write anything yourself, you usually have to battle through numerous texts and through pages and pages of references and academic literature. A computer program that can quickly process the text, provide a meaningful summary of its content or even answer questions about it would obviously be of great practical value in such a situation.

Ivan Titov and his team of researchers, splitting their time between Saarland University and the University of Amsterdam, are currently working on this problem. Titov is interested in how computers can learn to understand the meaning and the relationships between words in sentences and within texts. 'The model that we have developed simulates how humans create texts. In order to understand texts, we get our computers to work through this process but in the reverse direction: given the text the computer will uncover its meaning or even intent of the writer' explained Dr Titov. However, Titov and his group do not themselves stipulate a fully detailed model and the rules contained within it, instead, they use millions of sentences to generate both the model and the rules. The sentences that are analysed are drawn from large collections, such as Wikipedia. Analysis of this massive dataset requires a lot of computing power, with the specially developed algorithms running on around one hundred computers.

The idea is to develop software that enables computers to identify hidden, context-dependent relationships between words and clauses in texts, as the following example shows. Looking at the two sentences: 'John has just graduated from Saarland University. He is now working for Google.' it is clear even to a computer that John and Saarland University are linked by the relationship 'has graduated' and that John and Google are connected by the relationship "is working for". But the model developed by the Saarbr?cken computer scientists can also recognize that John studied at Saarland University; very probably in the Department of Computer Science and Informatics. Once computers can understand these patterns in human language, the next step for the researchers is to apply the method to get machines to automatically produce meaningful summaries of short texts and to answer questions about the text content.

Beside Ivan Titov Hans Uszkoreit is awarded with a Google Focused Award worth US$ 220.000. Uszkoreit is professor of Computational Linguistics at Saarland University and Scientific Director at the German Research Center for Artificial Intelligence. He is interested in how computers can indentify linguistic relationships in large text collections.

Through its Focused Research Award program, the search engine provider Google supports research of major interest to the company itself and to the field of informatics. Prize winners receive free access to Google tools and technologies.

Deluded salary demands pricing many out of new jobs

Pay

By Paul Clarke, 18 Jul 2013

Do you know how much you?re worth on the job market? It?s great if you suddenly discover that switching roles could result in a 30% salary uplift, but increasingly candidates are bidding themselves out of the market with unrealistic pay expectations.

Financial professionals in supposedly ?hot? job areas are holding out for unrealistically high salaries brought about by popular perceptions that they should be earning far more than employers are willing to pay. And, according to one recruiter, recruitment firms must take some of the blame.

Related articles:

The high paying banking jobs that nobody?wants

How Switzerland plans to hammer banking pay?too

Actuaries, the maths whizzes who have supposedly been in high demand for years now, are particularly culpable when it comes to buying into their own hype, believes Dr Geraldine Kaye, managing director of actuarial recruitment consultancy GAAPS Actuarial.

?We now see candidates reject actual job offers with extremely realistic and generous salary packages because they have been seduced by recruitment consultants who tell them an alternative job will pay even more, only to find those expectations prove to be fantasy and end up with no job at all,? she said.

In Europe, the Solvency II regulation helped drive contractor rates for specialist actuaries as high as??2k a day, and insurance firms attempted to lock them into full-time roles by bumping up salary packages. That ship has now sailed, and these sort of bubbles are not restricted to insurance ? investment banks and hedge funds are vying over compliance staff, which has helped drive salaries higher, while change management professionals ? helping to shake up banks? internal processes ? have been hot property for over two years now.

?Some investment banks have been willing to offer 50% pay rises to compliance staff in order to persuade them to move, because there is such a shortage of relevant skills,? said Andrew Breach, director and head of global banking and asset management recruitment at Page Executive. ?However, this is for the very best people ? there are a lot of people not up to the calibre that the banks demand who still expect big pay rises for switching jobs.?

However, it would be unfair to pin the blame entirely on recruiters. A lot of people are coming on to the job market for the first time in years, and have a dated view of what they should be earning, believes Ben Cowan, director of recruiters Astbury Marsden.

?We?d make an effort to manage expectations ? supply and demand go in cycles and very often someone can come to market demanding salaries that are entirely out of line with the market,? he said. ?However, some recruiters ? particularly smaller ones without a deep client base and candidate network ? will advertise jobs at the highest end of the market to attract candidates, which can skew their view of what they should be paid.?

Some people also convince themselves of their own worth, believes Breach: ?We managed to secure a candidate, who was earning ?50k, a pay rise to ?65k for switching from a large bank into a boutique player, but their mentor then convinced them they should be earning ?80k, which was never going to happen. It?s in the interest of a recruiter to try and secure a bigger salary, but not to the point where we undermine our client relationships.?

?There are a lot of people out of touch with reality ? credit derivatives professionals, people with expertise around FACTA and senior change professionals, all whom believe they should be earning salaries banks haven?t been willing to pay for years,? added Cowan.

Kaye, however, believes that recruiters have a lot to answer for, particularly when finding work for people from outside the City. One actuary came to London with a job offer, only to be told by recruiters that she wasn?t earning market rate, she said: ?So she declined the original offer, to find that other job offers never materialised. I find this irresponsible on behalf of my industry and a big dose of realism is required otherwise both employers and potential future employees will lose out more and more.?

Want To Know How Much A Top Ranking Professional Gamer Makes?

By Matt Hawkins

With the recently wrapped up Evo Championship Series, along with how League of Legend players are now considered athletes in the eyes of the US government, awareness of professional gamers are quite high these days.

And whenever eSports makes headlines, the same basic question is always asked: how much money do they make? Thanks to e-Sports Earnings (http://www.esportsearnings.com/players), now we know. They recently ranked the top 100 players, based upon their overall earnings.

Business Insider decided to profile the top 15 and here's a few observations one is able to cull from both ends:

- Both the overall earnings and highest paying game are listed by e-Sports Earnings. In the cast of the latter, Dota 2 is the most popular among the top 15. It appears 5 times among the top fifteen earners, and accounts for 99% of the total earnings for their respective players.

- As one might expect, Koreans dominate the top 15, as well as the top 100 as a whole. Their preferred game is either StarCraft of WarCraft.

- At the very top is Johnathan Wendel, otherwise known as Fatal1ty, considered the first breakout star in the world of eSports, at least here in America (in Korea, they have plenty to choose from). He made $454,544.98 overall, with over half of that stemming from earnings from Painkiller.

- In the case of Wendel, and pretty much everyone else, sponsorships make up a large portion of that pot, mostly with computer hardware companies. In some cases, they help to leverage a player's bottom line, even if they didn't do as well competitively this year (though one has to long how that can last).

- At the very bottom of the top 100 is Filip Kubski, aka eno, who still raked in a very respectable $66,183.28. Not half bad for being very good at Counter-Strike.

- Despite all the talk that centers on professional Street Fighter players, none of the games listed in the top 100 is a fighting game. Not a single one. It's all first person shooters or strategy games.

In the end, professional gamers have yet to earn a million dollars, but given how the world of eSports is still quite young, it's only a matter of time.

NFL dream ends for Lions' Best, beset by head injuries

DETROIT - The Detroit Lions made it official Wednesday and announced the release of concussion-plagued running back Jahvid Best, who had not played in a game since October 2011.

"I want to thank the Detroit Lions organization for drafting me and giving me an opportunity to fulfill my dream and play in the National Football League," Best said in a statement released through the team. "My time as a member of the Lions was a very special time in my life. My teammates, the members of the organization, the Lions fans and the people of Detroit will hold a special place in my heart. I'll always be a Lion."

Best played in 22 games for the Lions over two seasons since the team traded up in the 2010 draft to select him 30th overall out of California.

He was a dual threat out of the backfield and the kind of explosive weapon the Lions desired in their offense to complement quarterback Matthew Stafford and receiver Calvin Johnson. And he was exactly that for a brief time.

But the epitaph on Best's Lions career will be as the poster child for the NFL's handling of concussions amid raging lawsuits from former players who say the league did not do enough to protect them.

Best entered the NFL having suffered at least one serious concussion during his final season at Cal. In 2011, he suffered two head injuries: one in the exhibition season and one in an Oct. 16 loss to the 49ers that ended his season and ultimately his Lions career.

Doctors didn't clear him for contact and he missed the 2012 season after he was placed on the physically unable to perform list Aug. 27.

Best still counts about $1.1 million against the salary cap this year and next. He has been paid all the money he's owed.

Best finished his Lions career with 945 rushing yards on 255 carries for a 3.7-yard average and six touchdowns. He also had 85 receptions for 774 yards and three TDs.

"Jahvid is as fine a person and professional as I have ever worked with," Lions general manager Martin Mayhew said in a released statement. "He was the consummate teammate and always did everything asked of him. We wish Jahvid the very best in all his future endeavors and have no doubt that he will be successful in whatever path he chooses."

HTC One Mini Hands On: Hey There Lil' Speedster

It's been leaked on more than adult diapers, and now the HTC One mini (all lowercase, because it's so small, see?) is real. The idea is that it's a smaller, cheaper version of the our current favorite phone, the HTC One. But to accomplish such shrinkification and encheapenment, sacrifices must be made. Let's take a look.

What to expect from the NHS for mental health in London?

Basically, I am horribly depressed, and have been forever and it is wrecking my life. I have no idea if I just need a regular counsellor for a few months to talk stuff out, or a short/long run of meds, or both, or (I suspect) some magician to say 'you have these three things feeding into each other but the root cause is classic lifelong undiagnosed ADD (or something) so short term solutions for the secondary problems and pills/CBT for the big one'

If I go to my GP...what then? Should I expect to be fobbed of with Prozac for a few month s? Wait three months to speak to someone who makes me wait another three to speak to a specialist? Worse?

If I am impatient and can afford to go private...where would I start?

Most of my experience with NHS care is getting any cheap pill from a GP on the day, waiting many months to see anyone else unless an emergency. I am not an immediate physical danger to myself (or anyone else), just in danger of things getting worse up to that point if I have to wait too long.

I just want to know what to expect...and possibly any 'do say --- and don't say---' advice.

Thanks!

Signal or Noise? NEA's Experience with Signaling Risk in Seed ...

*This post is a follow-up to my ?Ask a VC? interview with Leena Rao at TechCrunch who posed the question, ?Why does a $2.6 billion fund make seed investments?? ?

NEA is one of the largest VC firms by assets under management, and has quietly become one of the most active seed investors in the industry. Launching a seed program was controversial, both within the firm and throughout the seed investment community. The primary concern was ?signaling risk?, or the notion that when a large VC fund makes a seed investment but chooses not to invest in a Series A round, the company?s ability to raise additional capital is significantly impaired. That negative ?signal? could damage both the reputation of the company and the relationship between the entrepreneur and its investor. After 35 years of building a reputation of trust and respect with entrepreneurs, we probably worried as much?or more?about this ?signaling risk? than anyone. As a result, since launching a dedicated seed program in early 2011, it?s something we have proactively measured and monitored from day one. The early results so far have been surprising to many with whom we?ve shared the data.

NEA?s seed program has made more than 50 investments totaling north of $20 million. The portfolio spans multiple sectors of technology (consumer, enterprise, healthcare, energy) and geography (Silicon Valley, Boston, New York, LA, and DC) and represents the diversity of interests and strategies employed by our global partnership. We have recently analyzed our first cohort of 35 seed investments, all of whom raised their initial seed rounds between March 2011 and July 2012.? The data is as follows:

  • 35 total companies (100%)
  • 5 Series A Investments Led by NEA (14%)
  • 9 Series A Investments Led by Other VCs (26%)
  • 14 Total Series A Investments (40%)
  • 5 Wind Downs or <2x M&A exits (~14%)
  • 16 companies currently ?too early to tell?* (46%)
*this category includes companies that have not yet tried to raise capital, have raised seed extensions in advance of Series A, or are otherwise too early to tell

Given all of our concern about signaling risk, we expected to see more companies that are NOT funded by NEA struggle to raise a Series A.? Instead, we have found the opposite.

  • At this stage, 40% of our seed companies are getting financed by a VC firm, NEA or otherwise, at Series A.? Our best guess is that more than 50% will be successful when this cohort fully matures.
  • Our seed funded companies have been almost 2x more likely to get financed by another VC firm, NOT NEA.? This is the exact opposite of what you would expect to see if signaling risk was significant in determining whether or not other VC firms would invest in NEA seeded companies.

The fact is that many VC firms choose to invest in NEA-seeded companies even if NEA does not lead the Series A.? There are many reasons why this occurs, but a few of the more consistent ones are:

  • Strong Fundamentals Speak for Themselves:? When we seed a company, we invest in great people, differentiated products, and large market opportunities. These fundamentals tend to be more important than the brand name or composition of a company?s investor syndicate, and tend to be highly sought after by many VC firms including NEA.
  • Entrepreneurs Have Many Choices:? We are privileged to work with great entrepreneurs who have many options for financing their company.? Many times other VCs are willing to offer more attractive options than we are able to provide.? We are thrilled when our seed companies reach these important milestones, independent of the dollar amounts we?ve invested.
  • We Are Not Always the Best Long Term Partner:? Seed companies change course frequently, and pivot into spaces or sectors that align better with other VC firms or partners. These shifts could also result in direct competition with companies in our existing portfolio, and when this occurs we do everything we can to manage conflict and maintain trust with our entrepreneurs and co-investors.
  • VCs Don?t Always Follow the Herd:? The VC community is diverse and sophisticated, and many firms weigh investments on their merits as they see them, not another firm?s opinion.? Herd mentality is less prevalent in venture capital than some might think.

On this last point, it is important to remember that building a successful start-up is one of the hardest undertakings on the planet.? It should not be surprising that investing in start-ups is equally challenging.? When we make a decision to invest?or not?in a Series A, it does NOT always mean we?ve made the right call.? We are human and we make mistakes. We aim not to repeat those mistakes at Series B, Series C, and beyond.

To be clear, we are not claiming that signaling risk does not exist.? To this day we are still very careful and selective about our seed investing for this very reason.? Entrepreneurs have many choices for how to build their seed syndicates, and those that choose to work with NEA get a partner with a long term perspective, at any and every stage of their growth, no matter how much money we?ve invested.? We aspire to help entrepreneurs build very large companies, and have a track record of doing so that spans four decades.? This is the strongest signal we send to our entrepreneurs, to our co-investors, and to the market, and it is a signal that hopefully continues to drown out the noise of signaling risk.

Jon Sakoda is a Partner at NEA and co-heads NEA?s seed investing program. Jon?s perspectives on VC and entrepreneurship can be found at www.jonsakoda.com or on Twitter @jonsakoda.

Top MAC Football Players of 2013: #28, Colby Way, Buffalo DL

Let me just get this out of the way: Roosevelt Nix, you had a good freshman year, you are 3x 1st Team All-MAC and with your help Kent has won 21 games in three years. But Colby Way is the best big Defensive Lineman in the MAC. Way is five inches taller than Nix, which makes Way a threat to the passing game as Matt Schilz found out when he was intercepted by Way in 2012's finale.

Nix has 22 more career tackles and 9.5 more career sacks, but most of that can be attributed to Nix's freshman year. Nix excelled immediately with 43 tackles and 9 sacks, while Way saw playing time sparingly recording only 9 tackles. Since then, Way has outperformed Nix. In 2011, Way tallied 49 tackles and 3 sacks while Nix earned his second 1st team All-MAC honor for 39 tackles and 4.5 sacks. In 2012 Nix somehow was a 1st-team All-MAC selection with 56 tackles and 6 sacks, while Way wasn't even a 3rd Team selection with 58 tackles, 7 sacks and an Interception.

Way earned his first start seven games into the 2011 season, and there were not a lot of expectations for him in 2012. With Steven Means on one side and Khalil Mack on the other side there was room for other players on the UB front seven to exploit one-on-one matchups. Way did just that and in the process was one of the most pleasant surprises of UB's 2012 season.

Mac68mini_medium_medium

As UB enters it's most anticipated season since 2009, Way represents a striking difference between the Gill era teams and the Quinn era teams,
the trenches. Gill's aim was to spread the field and use speed to move the offense, and relied on a speedy and opportunistic secondary to make up
for a lack of push on the defensive line.

Quinn's teams have yet to experience the success of Gill's however the offensive and defensive lines have shown strength that has never been seen at UB before. This was best displayed in the 2012 opener at Georgia, where Way sacked Aaron Murray twice and UB recorded 3 sacks, the same number of sacks Alabama recorded against Georgia.

Like Najja Johnson, Way has not received as much attention as he deserved, but that is changing. Colby Way is 1st team on Phil Steele's preseason All-MAC team. In addition to getting more attention from the media, Way will get more attention from opposing linemen, as Steven Means is now a Tampa Bay Buccaneer, Way will see more double teams his way this year. Finally and most importantly, Way has the opportunity to make his third consecutive Academic All-MAC football Team. Way has been able to excel on the field while maintaining a 3.49 GPA in Engineering.

Nix who?

(AP) ? As they began deliberating in George Zimmerman's murder trial, three of the six jurors wanted to acquit him while the other three wanted to convict him of either murder or manslaughter, one of the jurors said.

The six-woman jury ultimately voted to acquit Zimmerman in the fatal shooting of 17-year-old Trayvon Martin.

Zimmerman was charged with second-degree murder in last year's shooting but the jury also was allowed to consider manslaughter.

The woman, known as Juror B37, told CNN's Anderson Cooper on Monday that when the jury began deliberations Friday, they took an initial vote. Three jurors? including B37 ? were in favor of acquittal, two supported manslaughter and one backed second-degree murder. She said the jury started going through all the evidence, listening to tapes multiple times.

"That's why it took us so long," said B37, who said she planned to write a book about the trial but later had a change of heart.

When they started looking at the law, the person who initially wanted second-degree murder changed her vote to manslaughter, the juror said. Then they asked for clarification from the judge and went over it again and again. B37 said some jurors wanted to find Zimmerman guilty of something, but there was just no place to go based on the law.

B37 said jurors cried when they gave their final vote to the bailiff.

"I want people to know that we put everything into everything to get this verdict," said the juror, whose face was blacked out during the televised interview but who appeared to become choked up.

The interview came two days after the jury acquitted Zimmerman, a former neighborhood watch volunteer, of second-degree murder in the shooting death of Martin in a gated community in Sanford, Fla. Martin was black, and Zimmerman identifies himself as Hispanic. Zimmerman was not arrested for 44 days, and the delay in charging him led to protests from those who believed race was a factor in the handling of the case.

While prosecutors accused Zimmerman of profiling Martin, Zimmerman maintained he acted in self-defense.

Juror B37, the only juror to speak publicly about the case so far, said Monday that the actions of Zimmerman and Martin both led to the teenager's fatal shooting, but that Zimmerman didn't actually break the law.

While Zimmerman made some poor decisions leading up to the shooting, including leaving his car when police told him not to, Martin wasn't innocent either, the juror said.

"I think both were responsible for the situation they had gotten themselves into," said the juror. "I think they both could have walked away."

The juror said Sanford Police Detective Chris Serino made a big impression on her, because he would have been accustomed to dealing with murders and similar cases. He would have known how to spot a liar, and yet he testified that he believed Zimmerman, the juror said.

Legal analysts agreed that Serino's testimony was a blow to the state's case. The Sanford police were criticized last year for not arresting Zimmerman, and Gov. Rick Scott later appointed a special prosecutor, who brought charges against the neighborhood watch volunteer.

The juror said she didn't think Martin's race was the reason Zimmerman followed him on a dark, rainy night. She said she also believed Martin threw the first punch and that Zimmerman, whom she referred to as "George," had a right to defend himself.

"I have no doubt George feared for his life in the situation he was in at the time," the juror said.

The juror said she was not impressed by the testimony of Rachel Jeantel, who was talking with Martin by cellphone moments before he was fatally shot by Zimmerman.

"I didn't think it was very credible, but I felt very sorry for her," the juror said. "She didn't want to be there."

The juror also commented on defense attorney Don West's knock-knock joke about knowing who Zimmerman was during opening statements.

"The joke was horrible. Nobody got it," she said.

Juror B37 outlined to CNN the process she and the other five jurors went through in their deliberations. She said they spent the first day electing a foreman and getting organized. She said the jury instructions weren't immediately clear and the evidence was in no order whatsoever.

She said it was a difficult process.

"We thought about it for hours and cried over it afterwards," she said. "I don't think any of us could ever do anything like that ever again."

Martin Literary Management announced Monday that it was representing B37 and her husband, who is an attorney. The names of the jurors have not been released, but during jury selection it was disclosed that B37 works in an unspecified management position and has two adult children.

But agency head Sharlene Martin released a statement late Monday saying she was no longer representing the juror and that the juror had dropped the book idea. It included a statement that she said was crafted in conjunction with agency in which the juror explained that being sequestered had kept her shielded "from the depth of pain that exists among the general public over every aspect of the case." The juror said that the book was meant to show that our justice system "can get so complicated that it creates a conflict with our 'spirit' of justice."

The Associated Press was unable to reach the juror.

In a separate interview, Jeantel was asked by CNN's Piers Morgan whether she thought race was a factor in Zimmerman's decision to follow Martin prior to their fight.

"It was racial," she said. "Let's be honest. Racial. If he were white, if Trayvon was white and he had a hoodie on, what would happen?"

She noted that the altercation happened in the early evening, when many people are out walking their dogs or doing other things.

Morgan played back a recording of the juror's comments to CNN about Jeantel's education level and speech, and the witness said it made her sad and angry. Jeantel, who is black, said she also had a feeling that the jury would return a not-guilty verdict.

"They're white," she said of the jury at one point. "Well, one Hispanic. But she's stuck in the middle. I had a feeling it was going to be a 'not guilty.'"

While the court did not release the racial makeup of the jury, the panel appeared to reporters covering jury selection to be made up of five white women and a sixth who may be Hispanic.
